These Terms of Service ("Terms") govern your use of the Zwier mobile application and related services ("Service"), operated by Wem ("we", "us", "our"). By creating an account or using Zwier, you agree to these Terms.
1. Description of Service
Zwier is an event planning application that helps groups coordinate and organize events. The Service includes:
- Creating and managing group events.
- Finding dates that work for all participants.
- Building shared itineraries with activities and locations.
- Tracking and splitting expenses among event members.
- Assigning and managing tasks.
- Voting on decisions through polls.
- Sending notifications and updates to event members.
2. User Accounts
To use Zwier, you must create an account using your email address or Google account. You are responsible for:
- Providing accurate account information.
- Keeping your account credentials secure.
- All activity that occurs under your account.
You must be at least 16 years old to create an account.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Harass, abuse, or harm other users.
- Upload malicious content or attempt to compromise the Service.
- Create fake accounts or impersonate others.
- Use automated tools to access or scrape the Service without our permission.
- Interfere with the proper functioning of the Service.
We reserve the right to suspend or terminate accounts that violate these terms.
4. Expense Splitting
Zwier provides tools to calculate how expenses should be split among event members. Please note:
- Zwier calculates suggested splits based on the data you enter. We do not guarantee the accuracy of calculations if incorrect data is provided.
- While we strive for accuracy, Zwier's expense calculations may contain errors due to software bugs, rounding, or other technical issues. We are not liable for any financial loss or disputes arising from incorrect calculations. You are responsible for verifying the amounts before making payments.
- Zwier does not process payments. Actual payments between users happen outside the app (e.g., via bank transfer, payment apps, or cash).
- Zwier is not responsible for disputes between users about expenses or payments.
- Expense data is visible to all members of the event in which it is recorded.
5. User Content
You retain ownership of the content you create in Zwier (event details, expenses, itineraries, etc.). By using the Service, you grant us a limited license to store, display, and transmit your content as needed to provide the Service to you and your event members.
6. Third-Party Services
Zwier uses and integrates with third-party services, including:
- Supabase: For data storage, authentication, and backend services.
- Google: For optional sign-in authentication.
- Expo and Firebase: For push notification delivery.
- Viator: For activity and experience suggestions. When you follow a Viator link, you leave Zwier and are subject to Viator's own terms and privacy policy. We earn affiliate commissions on bookings made through these links. We are not responsible for the quality, availability, cancellation, or any other aspect of activities or experiences booked through Viator. Any issues with bookings should be resolved directly with Viator or the activity provider.
We are not responsible for the practices or content of third-party services.
7. Intellectual Property
The Zwier name, logo, design, and source code are the property of Wem. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.
8. Availability and Pricing
We aim to keep Zwier available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We may also introduce paid features or change pricing in the future.
We do not guarantee the delivery of push notifications, as this depends on your device settings, operating system, and third-party services (Firebase, Apple Push Notification service).
9. Limitation of Liability
To the maximum extent permitted by law:
- Zwier is provided "as is" without warranties of any kind, whether express or implied.
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
- Our total liability to you for any claim arising from the Service is limited to the amount you paid us in the 12 months before the claim (if any).
- We are not responsible for financial disputes between users, inaccurate expense calculations due to incorrect input, or any losses resulting from reliance on the Service.
10. Termination
You may delete your account at any time from the profile screen in the app. We may also suspend or terminate your account if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends immediately.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes through the app or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or the Service will be resolved in the courts of the Netherlands.
